Las Vegas Slip and Fall Injury Enquiries

Falls in casinos, hotels, stores and apartment complexes, and how Nevada premises liability works.

Why slip and fall cases in Las Vegas need fast action

Las Vegas has more square feet of casino floor, hotel lobby and resort pool deck than almost anywhere, and those surfaces see spilled drinks, polished marble and crowds around the clock. Resorts run sophisticated surveillance, but footage is often recorded over on a fixed schedule unless someone asks for it to be preserved. The single most useful step after a fall on someone else's property is to report it to security or management, get a copy or the number of the incident report, and ask in writing that video be kept. Our FAQ covers how to make that request.

Casino and hotel falls

Wet floors near bars and pools, uneven transitions between carpet and tile, poorly lit stairs and crowded escalators are common causes. Resorts usually have their own risk-management teams who move quickly; a polite, factual incident report and photos taken before anything is cleaned up make a large difference later.

Stores, restaurants and apartment complexes

Grocery spills, broken sidewalks, loose handrails and unlit parking lots also lead to claims. In apartment complexes, the question is often whether management knew about a hazard, such as a broken step reported weeks earlier, and failed to fix it.

Most of what proves a claim is easiest to collect in the first three days.

How Nevada premises liability works

Property owners and managers must use reasonable care to keep their premises safe for people lawfully there. A claim generally needs to show a dangerous condition existed, that the owner created it, knew about it, or should have found it with reasonable inspection, and that it caused the injury. Warning signs, how long a spill sat, and inspection logs all matter. Being distracted or wearing unsuitable shoes does not automatically defeat a claim; Nevada's comparative fault rule (NRS 41.141) reduces recovery by your share instead of barring it unless you were more at fault than the property owner. The Nevada accident guide explains that rule with an example.

Injuries that show up later

Falls cause wrist and hip fractures, knee injuries and head injuries that are easy to underestimate. Getting checked promptly protects your health first and also creates the record that links the injury to the fall.

Deadlines and evidence

Most injury claims in Nevada must be filed within two years (NRS 11.190(4)(e)), but evidence is the more urgent clock. Take photos of the exact spot, your shoes and the lighting, collect witness names, keep the clothes you were wearing, and save receipts showing you were a guest or customer. If the fall happened on government property, such as a public building or sidewalk, extra procedural rules can apply, so talk to an attorney early.

Visitors who have already flown home

Many people injured in a Las Vegas resort live in another state. A Nevada claim can usually move forward after you leave, with records and photos sent electronically; what matters is acting before the two-year deadline. See accidents on the Strip for more on visitor cases.

The clock starts on the day of the crash. Nevada gives most injury claims two years.

Talking to an attorney

Premises cases are evidence-heavy and often contested, which is why many people want an opinion before speaking with a resort's insurer. A free review through this site is passed to an independent Nevada-licensed attorney who decides whether to contact you. Use the enquiry form, call (725) 212-4114, or read how the service works first. Related pages: dog bite injuries, which are also premises-related, and the full list of accident types.
